Probate is a legal process that is used to oversee the distribution of assets and to settle an estate after someone has died. The probate process ensures that the heirs or beneficiaries of a decedent receive clear title to the decedent’s property. During probate, the decedent’s personal representative (also called the executor if the decedent left a will or the administrator if the decedent did not have a will) locates the decedent’s assets, pays his or her debts, and distributes the remainder of the estate to the beneficiaries named in the will or to the heirs as specified by state law.
